OurBus Charters

1. Scope of These Terms

These Brokerage Terms & Conditions (“Terms”) govern the purchase of charter transportation services arranged through the OurBus Charters website and related communications, and your use of transportation services coordinated through the OurBus Charters platform. By requesting a quote, confirming a booking, paying a deposit, or using transportation services arranged through OurBus Charters, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not book or use charter transportation services arranged through OurBus Charters. These Terms establish a contractual relationship between you and Rally Bus Corp., doing business as OurBus Charters (“OurBus Charters,” “we,” “us,” or “our”), solely in its capacity as a transportation broker and booking intermediary.

2. Role of OurBus Charters as a Broker

OurBus Charters operates as a transportation broker that arranges charter transportation services using independent third-party motor carriers (“Operators”). OurBus Charters:

  • does not own, operate, or maintain buses or vehicles
  • is not a motor carrier
  • does not transport passengers
  • does not employ drivers

All transportation services are provided by independent licensed and insured motor carriers. Operators are solely responsible for the operation, maintenance, safety, and regulatory compliance of their vehicles and drivers. OurBus Charters does not supervise or control the operation of motor carriers and assumes no liability for the acts or omissions of Operators, except to the extent required by applicable law.

3. Third-Party Operators & Vehicle Substitution

OurBus Charters arranges transportation through a network of licensed motor carriers. The specific Operator assigned to your trip and the specific vehicle provided may change due to:

  • availability
  • mechanical issues
  • weather
  • regulatory requirements
  • operational constraints

If a substitution is required, OurBus Charters will make commercially reasonable efforts to provide a comparable vehicle and service level.

4. Quotes, Pricing & Payment Terms

All quotes are provided in U.S. dollars and are based on the trip details provided at the time of the quote, including:

  • travel dates
  • pickup and drop-off locations
  • passenger count
  • vehicle type
  • trip duration
  • mileage
  • Operator availability

Quotes become confirmed once the booking is accepted and the required deposit is received.

Unless otherwise specified in writing:

  • Prices include known taxes and mandatory regulatory fees.
  • Prices may change if trip details are modified.
  • Additional charges may apply for itinerary changes or overtime usage.

Deposits

Most bookings require a deposit of approximately 25% to secure the reservation. Certain larger bookings or multi-vehicle charters may require 10%–25% deposits, depending on Operator requirements. Reservations are not confirmed until the deposit is received.

Balance Due

The remaining balance is due 15 days prior to the scheduled travel date, unless otherwise specified in your booking confirmation. Failure to pay the balance by the due date may result in cancellation of the reservation and forfeiture of the deposit.

5. Cancellations & Refunds

Unless otherwise stated in your booking confirmation:

  • Cancellations made 15 days or more before the travel date are eligible for a full refund of amounts paid
  • Cancellations made within 15 days of the travel date may incur partial or full charges depending on Operator commitments and trip proximity.

Refunds are issued to the original payment method and typically process within 5–10 business days, subject to payment processor timelines.

6. Modifications & Itinerary Changes

After booking, you may request changes to the itinerary including:

  • pickup or drop-off times
  • locations
  • routing
  • stops
  • passenger counts

Modifications are generally permitted up to 72 hours prior to departure, subject to Operator availability. Changes that increase mileage, hours, or vehicle size may result in additional charges.

7. Wait Time & Overtime

Charter trips are scheduled based on the itinerary confirmed at the time of booking.

If the trip exceeds the scheduled duration, additional overtime charges may apply at the hourly rate specified in the booking confirmation. Overtime is subject to:

  • driver availability
  • federal hours-of-service regulations
  • Operator approval

8. Vehicle Features, Images & Amenities

Vehicle images, descriptions, and amenity lists displayed on the OurBus Charters website are representative only. Actual vehicle models, layouts, and amenities may vary depending on:

  • Operator
  • location
  • availability

Final vehicle details and amenities will be confirmed prior to departure when possible.

9. Service Delays, Breakdowns & Contingencies

Arrival and departure times cannot be guaranteed.

Delays may occur due to circumstances beyond reasonable control, including:

  • traffic
  • weather
  • road conditions
  • mechanical issues
  • accidents
  • regulatory restrictions

If a mechanical failure or service disruption occurs, OurBus Charters will make commercially reasonable efforts to coordinate with the Operator to arrange a replacement vehicle or alternative transportation when available. OurBus Charters is not responsible for consequential damages, missed connections, or indirect losses resulting from delays.

10. Operator Cancellations

In rare circumstances, an Operator may cancel due to unforeseen operational issues. If this occurs, OurBus Charters will make commercially reasonable efforts to secure a replacement Operator. If a suitable replacement cannot be arranged, the customer will receive a refund of amounts paid for the affected transportation services. OurBus Charters shall not be liable for consequential damages arising from such cancellations.

11. Passenger Conduct & Damage

Passengers must comply with all Operator rules, safety requirements, and applicable laws. You are responsible for any damage caused by your group to the vehicle or equipment, including but not limited to:

  • interior damage
  • vandalism
  • excessive cleaning
  • broken fixtures

Any damage or cleaning fees assessed by the Operator may be charged to the payment method on file.

12. Baggage & Personal Belongings

Baggage capacity varies by vehicle type. You are responsible for informing OurBus Charters of luggage requirements during booking. Neither OurBus Charters nor Operators are responsible for loss, theft, or damage to personal belongings or baggage.

13. Accessibility & Special Requirements

ADA-accessible vehicles and other accommodations may be available in certain markets. Requests for accessibility features should be made as early as possible and are subject to Operator availability.

14. Insurance & Liability

Operators maintain commercial auto liability insurance as required by federal and state regulations. OurBus Charters does not provide transportation insurance coverage and is not liable for injuries, losses, or damages arising from the operation of motor vehicles by Operators. Certificates of Insurance may be provided upon request when available.

15. Force Majeure

Neither OurBus Charters nor Operators shall be liable for delays or failure in performance caused by events beyond reasonable control, including:

  • acts of God
  • extreme weather
  • natural disasters
  • government actions
  • public emergencies
  • road closures
  • labor disputes

16. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.

17. Entire Agreement

These Terms, together with your booking confirmation and invoice, constitute the entire agreement between you and OurBus Charters regarding charter transportation services arranged through our platform.
